The federal government, counties, and municipalities must respect the rights of individuals enshrined in the U.S. Constitution.  These rights include the right to free speech, free press, free exercise of religion, privacy, right to be free from unreasonable searches and seizures of property, the right to be charged with a crime when one is arrested, the right to vote if one is eligible, and other things.  These rights are called civil rights.

 

If a government employee’s conduct violated a clearly defined civil right, then the employee and the governmental entity can be liable under federal law.
